An entrepreneur running or establishing any industry or process, and discharging effluent/emitting pollutants is required to obtain prior Consent or NOC from the respective State Pollution Control Board (SPCB), which needs to be obtained in two phases: Consent to Operate (CTO) and Consent to Establish (CTE). Siting guidelines are issued for each industry by respective State Government.

 

Central Pollution Control Board (CPCB) has categorised diverse industries based on the amount of pollution emitted. This categorisation of industries is applicable under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.

Categories of Industries under Pollution Control Board

  • Industrial sectors having Pollution Index Score of 60 & Above- Red
  • Industrial sectors having Pollution Index Score of 41 to 59- Orange
  • Industrial sectors having Pollution Index Score of 21 to 40- Green
  • Industrial sectors having Pollution Index Score incl, & upto 20- White

Who should apply?

Industries falling in the red, orange or green category are mandatorily required to secure their CTO/CTE from the respective State Pollution control Board (SPCB).

Industries under the white category do not require CTO/CTE from the State Pollution control Board (SPCB).

Types of NOC

Consent to Establish (CTE)

This consent is to be obtained prior to establishing any industry or process from the respective State Pollution Control Board (SPCB).

Consent to Operate (CTO)

Once the industry or process plant is established along with the required pollution control systems, the entrepreneur is required to obtain consent to operate the unit. This  consent is given for a particular period, which needs to be renewed regularly.
