What is Nomination?

Section 49 of the Legal Metrology Act, 2009 provides for – Offences by companies and power of the court to publish the name, place of business, etc., for companies convicted. Section 49 also gives you the opportunity to nominate a person to exercise all such powers and take all such steps as may be necessary or expedient to prevent the commission by the company of any offense under the Act. A different person can also be nominated for different branches and units.

Benefits of Nomination

Where an offence is committed by a company, and the company has nominated a person then penal liability under the Act substantially reduced.

When to do the nomination?

At the time of registration or any time after registration.

Registration

You have the option to register with your jurisdictional State – Controller of Legal Metrology or with Director – Legal Metrology, New Delhi. If you have manufacturing, packing and importing facilities in more than one State then it is advisable to register with Director – Legal Metrology, New Delhi.
