ESI is a self-financing social security scheme for the workers. Under section 2(12) of the ESI Act, 1948 the Act is applicable to non-seasonal factories employing 10 or more persons. Under section 1(5) of the ESI Act, 1948, the ESI Scheme has been extended to Shops, Hotels, Restaurants, Cinemas including Preview Theatres, Road-motor Transport Undertakings, Newspaper Companies, Establishments engaged in Insurance Business, Non Banking Financial Companies, Port Trust, Airport Authorities and Warehousing establishments employing 10 or more persons. Further, under section 1(5) the scheme has also been extended to Private Medical and Educational Institutions employing 10 or more persons in certain States/Union Territories.
The ESI scheme is now notified in 540 districts in 34 States and Union Territories, which include 354 fully notified districts and 186 partially notified districts. The scheme is yet to be implemented in Arunachal Pradesh and Lakshadweep.
Coverage
The existing wage limit for coverage under the Act is Rs. 21,000/- per month (Rs. 25,000/- per month in case of persons of disability)
When to register?
Immediately when meeting the threshold criteria under section 2(12) and 1(5) of the ESI Act, 1948
